TERMS & CONDITIONS FOR HOSTING SERVICE

Attention Minors: A parent, guardian, teacher, or other responsible adult must establish hosting service with Paraglide for you. (An adult's authorized payment for the hosting service subscription is their acknowledgement and acceptance of these terms and conditions for the hosting service.)

This Agreement is between you and Paraglide. It sets forth the terms and conditions of your use of our service. By using Paraglide's service you acknowledge that you are at least 18 years of age, have read, understood, and agree to be bound by all terms and conditions of this agreement, as well as any additional rules or policies that are or may be published from time to time. This constitutes the complete and exclusive agreement between you and Paraglide concerning use of our services; it supersedes all prior proposals, agreements, or other communications. Offers & prices are subject to change without notice. Refunds are at the discretion of Paraglide.

Changes to this agreement:

You agree that Paraglide may modify this Agreement, as well as any additional rules or policies that are or may be published by Paraglide. Your continued use of the Paraglide service shall constitute your acceptance of this Agreement as well as additional rules or policies that are or may be published by Paraglide or contractor, each with the new modifications. If you do not agree to any of such changes, you may cancel the Paraglide service. You acknowledge and agree that such cancellation will be your exclusive remedy and our sole liability if you do not wish to abide by any changes to this Agreement or any additional rules or policies that are or may be published by Paraglide. Note: Canceling Paraglide's hosting service will not affect your domain registration which is separate from your hosting service. Your domain is yours for the full term of its registration which you alone have exclusive right to renew for as long as you want. You own your Ipseity (subject only to the terms of the registration agreement between you and your registrar. Paraglide is not a registrar).

Agents & licenses:

You affirm that, if you are using the Paraglide service for someone else, you have the authority to make this agreement for that person as if that person had made this agreement. You accept liability for harm caused by abuse of the service by you. You agree to indemnify Paraglide, its owners and all who provide services in support of Paraglide from all liability that may arise from your abuse of the service.

Suspension & cancellation:

It is your responsibility to know the laws, customs and mores that determine which activities are without controversy both ethical and legal. While using Paraglide services you agree to only engage in activities that are unquestionably ethical and legal and do not in any way pose a security threat to Paraglide or its subscribers. For the security of Paraglide and hosting service subscribers all activities involving Paraglide's hosting service or equipment in any way which, in Paraglides's sole and exclusive judgment, are or appear to be inappropriate or unethical or illegal are prohibited. You acknowledge and agree that Paraglide may suspend or cancel your use of the Paraglide services for engaging in any such prohibited activity.

Your domain name is yours to keep: Once your domain name registration fee has been paid and your domain name has been registered it is yours to keep. It will never be subject to suspension or cancellation by Paraglide. However, if you fail to renew it with its current registrar or transfer it to another registrar and the current registration period expires then your domain name could be lost. Possession of your domain name is entirely separate from our hosting services. Our hosting services are NOT required to keep your domain name but, a hosting service is required for your domain to be accessible over the internet. Please see your domain registrar for Terms of Service regarding domain name registration. This includes domains registered through EV1servers.net. EV1servers.net is an independent registration service not affiliated with Paraglide.

Limitation of liability:

All information provided by a client is treated as confidential. You agree that Paraglide will not be responsible under any circumstances for any actual, assessed, or consequential damages you, your business, or anyone else may suffer because of either the use or lack of use of Paraglide services. Paraglide makes no warranties of any kind regarding any services offered or delivered. Paraglide shall not be liable for disruptions or improper operation of its equipment or software for any reason, including, but not limited to, vandalism, theft, phone service outages, internet disruptions, human error, extreme or severe weather conditions or any other causes. Paraglide will not be responsible for punitive or exemplary damages under any circumstances. In no case will you be entitled to recover damages from Paraglide. Paraglide assumes no liability of the client for any failure to follow this Agreement and any results caused by the acts, omissions or negligence of the client, sub-contractor or an agent of client or an employee of any one to them, including, but not limited to, claims of third parties arising out of or resulting from or in connection with the client's products, messages, programs, caller contracts, promotions, advertising, infringement or any claim for libel or slander or for violation of copyright, trademark or other intellectual property rights.

Agreement term:

The term of this Agreement will continue until a notice of cancellation by Paraglide or client is given, or until terminated under other provisions of this Agreement. Paraglide reserves the right to terminate this Agreement upon notification to the client. Paraglide may further suspend or terminate this Agreement immediately without notice at any time the client breaches any part of this Agreement, or if any program or facility used by Paraglide to implement this Agreement is disrupted or terminated for any reason beyond Paraglide's control.

Governing law:

The laws of the United States of America and of the State of North Carolina shall govern this Agreement, your rights and obligations and all actions contemplated by this Agreement. Nothing contained in this Agreement shall be construed as creating any agency, partnership, or other form of joint enterprise between the parties. In the event that any provision of this Agreement shall be unenforceable or invalid under any applicable law or be so held by applicable court decision, such unenforceability or invalidity shall not render any other provisions of this Agreement unenforceable or invalid as a whole. Paraglide has the right to amend, replace or remove any such unenforceable or invalid provision to correct the error, at its discretion.
